Houston Texans owner is fighting son’s claims that she’s incapacitated and needs guardian

Houston (AP) — According to court documents, the owner of the Houston Texans is resisting her son’s attempt to have her deemed incapable and to appoint a guardian.

The Texans, who won the AFC South this season,

are set to visit the Cleveland Browns on Saturday in what will be their first postseason game since the 2019 campaign.

This news of family strife comes at the right time.

In November, Robert Cary McNair Jr. submitted an application to the probate court in Harris County,

the home of Houston, seeking guardianship for Janice McNair, 87.

A judge last month temporarily sealed the application,

which outlines his justifications for wanting her judged incapable of supporting her.

The Texans’ chairman and CEO, Cal McNair, and his mother Janice McNair were “shocked”

by Cary McNair’s “drastic and unwarranted measures of alleging his mother is incapacitated, seeking to terminate her rights,

and appointing himself as her guardian to control her personal, financial, and medical decisions,”

according to court documents filed last month. Cal and Ms.

McNair strongly disagree with any suggestion or accusation that Ms. McNair is incapacitated or needs a guardianship”

Janice McNair, who took over as the Texans’ primary owner following her husband Robert “Bob” McNair’s death in 2018,

requested in a two-page declaration that all court documents related to the lawsuit be sealed in order to safeguard her private financial, medical, and personal data.

“Texans will be seriously impacted when the details of this family dispute become public,”

she stated.

“It will negatively impact our employees, business partners, and the team by causing an unnecessary and unfounded media stir regarding the ownership and direction of the Texans.”

Tuesday’s hearing on the motion to seal the records was presided over by Judge Jerry Simoneaux,

who on Wednesday issued an order requesting more information prior to rendering a decision.

Cary McNair’s guardianship application was kept temporarily sealed by the judge.

In response to emails on Wednesday seeking comment, the attorneys for Janice McNair, Cal McNair, and Cary McNair did not immediately reply.

Omar Majzoub, a Texans spokesman, stated that the team was silent on the matter.
